Taking on new people – contracts

Successful working relationships between employers and employees and between principals and contractors often depend (at least in part) on:

  • A correct understanding of whether the parties are employer and employee or principal and contractor; and
  • Having clear written terms of engagement between the parties.

Covering those two items at the start of the relationship is the best way to avoid the possibility of subsequent disputes.

Tyler & Co has long experience in crafting enforceable employment and contractor agreements.  We also draft ancillary documents such as employee manuals and policy statements on computer usage, smoking, discrimination and harassment.

To help you avoid problems in your employee/contractor arrangements, Tyler & Co can:

  • Analyse and advise whether particular arrangements are for employment or contracting;
  • Advise on statutory entitlements and obligations;
  • Draft employment and contracting agreements that comply with industrial laws;
  • Draft employee manuals and policy statements; and
  • Advise on your human resource management and training procedures.

Handling problem employees

Problems between people in the workplace can be devastating for morale and disastrous for productivity.  Resolution of such issues before they get out of control requires quick and careful management.

To help you to resolve workplace disputes, Tyler & Co can:

  • Advise you on each party’s contractual rights and responsibilities;
  • Advise you on statutory entitlements and obligations;
  • Advise you on procedures to follow and provide appropriate documents; and
  • Draft effective settlement agreements.

Redundancies

Retrenchment of personnel on the grounds of redundancy is never easy.  It needs to be handled with considerable care for the sake of the business, the people involved and other employees.

Tyler & Co has long experience of advising business owners and employees on handling redundancy.  To help you manage the process, we can:

  • Advise you on each party’s contractual rights and responsibilities;
  • Advise you on statutory entitlements and obligations;
  • Advise you on procedures to follow and provide appropriate documents; and
  • Draft effective settlement agreements.

Unfair dismissal claims

The law which provides remedies for unfair dismissal still applies to sole traders and partnerships in New South Wales, as well as to companies with 100 or more employees.

Tyler & Co has long experience of helping both employers and employees to resolve unfair dismissal claims. We can:

  • Advise you on statutory entitlements and obligations;
  • Initiate/defend unfair dismissal proceedings;
  • Represent you and negotiate with the other party on your behalf; and
  • Draft effective settlement agreements.
